LESSON 9- The Applicant - Have They Been Physically Hurt?

The Applicant - Have They Been Physically Hurt?

At first glance, the answer to the question, “Have They Been Physically Hurt?” may seem rather obvious.  After all, the Applicant is telling you about their accident or how someone caused them harm.

But did the Applicant really get physically hurt? Or was this injury an injury to the person’s mental well-being?

If there is no injury to a person’s body, then there is no case (at least as far as you’re concerned). It’s just that simple.

Of course, we have all heard of cases concerning “mental anguish”. But you have probably never heard anyone win a lawsuit based on mental anguish alone.

Usually, a claim of mental anguish is associated with traumatic physical injuries to the person or can even be those type physical injuries (or more probably death) to a loved one…more than likely, their child.

So, if the answer to “Have They Been Physically Hurt?” is “No”, then this is not a case for an independent Case Broker or an advance company. The independent Case Broker should display genuine and sincere sympathy and concern, but this case is not going to receive any advance money (or payment for you.)

But what if the answer is “Yes”?
