You Can't Give Legal Advice! Why? Because You Are Not a Lawyer

 

Another word to the wise: Don’t give the Applicant any legal advice.

Unless you have passed the bar exam in the state you are located in, it is actually against the law for you to give anyone any legal advice. In fact, you need to tell the Applicant, right at the beginning of your conversation with them, that you are not a lawyer and that you don’t work for one.  Actually, some Applicants may breathe a sigh of relief.

Also, you will need to tell them at the beginning that, because you are not a lawyer, the “lawyer privilege” doesn’t apply and so anything that the Applicant tells you is not confidential. This means that if you are asked about the conversation in a legal proceeding and ordered by a court, in some circumstances, you may have to reveal what the Applicant said.

All of this will be discussed again, but just remember: Don’t give the Applicant any legal advice.
