Lesson 13- People Injured By Other People Deserve Compensation
A person significantly injured by another person or organizational entity should be compensated for that injury.
Most people know this and agree with our judicial method of obtaining compensation from a party that has caused harm. It’s called a lawsuit.
Think about it this way,
The injured party did nothing wrong and yet an injury was caused by another person or party. The party that caused the injury cannot reverse time and make the injury go away. And they sure can’t do some type of mystical penance to relieve the injured party of their pain and suffering. The only way to approach “making it right” is for the injured victim to receive from the party that caused the injury some monetary compensation that is considered proportional to the injury caused. And because it is rare that someone voluntarily, out of the goodness of their hearts, pulls the money out of their wallets and compensates the victim, then, in those occasions when the money is not forthcoming, our laws provide a remedy and eventually the injured victim may receive the money they deserve either when the two parties reach a settlement of an amount or a court renders a judgment conferring the amount.
And when the injured party is forced to travel the judicial route (lawsuit) to acquire recompense, they become known as the “Plaintiff” and the party that caused the injury is considered the “Defendant.” These are two very important terms that will be used repeatedly in this Course, especially in the Legal and Vitals sections. Also, your Applicant, for advance company purposes, will always be the Plaintiff in the case.
The bottom line is that people injured (Plaintiffs) by someone else (Defendants) deserve compensation and the way they receive that compensation is either through a settlement or a judgment of a court.
